Key Points for Employers

  1. Disclosure of Pay Ranges: Starting October 29, 2025, employers with 25 or more employees must disclose pay ranges in job postings. This requirement also applies to promotions, transfers, and upon request by current employees.
  2. Workforce Demographic Data Reporting: As of February 1, 2025, employers with 100 or more employees are required to submit their most recent EEO-1 reports to the Commonwealth on an annual basis.
  3. Employee Protections: The law protects employees from retaliation for asking about salary ranges when applying for a job or promotion.
  4. Violations for Nonconformance:
  • 1st offense: Warning
  • 2nd offense: Fine up to $500
  • 3rd offense: Fine up to $1,000
  • 4th or subsequent offense: Fine of $25,000 or higher per violation
